PartyOS Terms of Use
English translation of the Terms of Use in Portuguese. In case of any discrepancy, the Portuguese version prevails (clause 1.5).
1. Identification and acceptance
1.1. The PartyOS platform, available at www.party-os.com ("PartyOS"), is operated by 68.266.823 ALEJO RODRIGUEZ, registered with the CNPJ under no. 68.266.823/0001-05, with address at Rua Ronald de Carvalho, nº 236, Copacabana, Rio de Janeiro/RJ, CEP 22021-020, support e-mail partyoperationsystem@gmail.com and WhatsApp +55 21 97418-7777.
1.2. These Terms govern the use of PartyOS by any person who browses, creates an account or buys tickets or services through the platform ("User").
1.3. By completing a purchase or creating an account, the User declares to have read and accepted these Terms and the Privacy Policy (in Portuguese). Before each payment, PartyOS displays an order summary with the total price and the link to these Terms.
1.4. To make a purchase, the User must be 18 years of age or older. The minimum age to enter each event is set by the Organizer and shown on the event page.
1.5. These Terms are available in Portuguese, Spanish and English. In case of any discrepancy, the Portuguese version prevails.
2. What PartyOS does
2.1. PartyOS is a technology platform that connects Users to events. PartyOS does not organize, produce or hold events, and does not sell tickets in its own name.
2.2. Definitions:
- Organizer: the person or company that holds the event, sets the prices, batches, entry rules and event policy, and sells its tickets through PartyOS.
- Own event: an event whose ticket is sold by the Organizer directly on PartyOS. The ticket is issued by PartyOS with a QR code.
- Management Provider: the company identified on the fee explanation page (www.party-os.com/en/support/fees) as the provider of the Purchase Management Service described in section 5.
- Managed-purchase event: an event whose ticket is sold by a third-party official platform (for example, Sympla or Ingresse), and which the Management Provider buys for the User.
- Official platform: the ticket sales website chosen by the Organizer for a managed-purchase event.
2.3. The page of each event states whether it is an Own event or a Managed-purchase event, and who is responsible for the sale.
2.4. Payments are processed by Asaas Gestão Financeira Instituição de Pagamento S.A. PartyOS does not store card data.
3. Registration, purchase and ticket delivery
3.1. To buy, the User provides their full name, e-mail and the other data requested on screen. The User is responsible for the accuracy of this data, especially the e-mail, to which the ticket is sent. Before paying, PartyOS suggests corrections for e-mails with a likely typo.
3.2. Before payment, PartyOS clearly shows: name, date, time and venue of the event; ticket type and batch; ticket price; each fee charged, separately; and the total price. No amount is charged beyond the total displayed.
3.3. Batches. The Organizer may sell tickets in batches with different prices. The applicable price is that of the batch in effect at the time the payment is confirmed. Closed batches are not reopened.
3.4. Half-price tickets (meia-entrada). Half-price tickets are governed by Law no. 12.933/2013 and Decree no. 8.537/2015. Whoever buys a half-price ticket must present, at the event entrance, the document proving the entitlement. Without the document, the Organizer may require the difference or deny entry. The offer and quota of half-price tickets are the responsibility of the Organizer.
3.5. Payment. The accepted payment methods (PIX and, when enabled, credit card) appear on the payment screen. The order is only confirmed after the payment is approved.
3.6. Delivery. For Own events, the ticket with a QR code is sent to the e-mail provided after the payment is confirmed. For Managed-purchase events, the delivery time and method follow section 5. If the ticket does not arrive, the User should check the spam folder and contact support (section 10), which can correct the e-mail and resend the ticket.
4. Fees
4.1. In addition to the ticket price, the fees below may be charged. Each one appears on a separate line in the purchase summary, with its amount in reais, before payment. More details at www.party-os.com/en/support/fees.
| Fee | When it applies | What it pays for |
|---|---|---|
| Service fee | Own events | Online sales: platform, secure payment, issuing of the QR code ticket and customer support |
| Processing fee | Credit card payment, when applicable | The cost of card processing and installments |
| Management fee | Managed-purchase events | The Purchase Management Service in section 5 |
4.2. The fees do not include physical delivery of the ticket or pick-up at a box office, services that PartyOS does not provide. No fee is charged at the event's official box offices.
4.3. PartyOS does not require the User to buy through the platform. When the Organizer offers other sales channels, the event page may list them.
4.4. For events held in the State of Rio de Janeiro, the charge complies with State Law no. 6.103/2011, as amended by Law no. 6.321/2012. The full text of the law is in the Annex to these Terms, as required by its art. 6.
4.5. Refunds of fees follow section 6.
5. Purchase Management Service
5.1. What it is. For Managed-purchase events, the Management Provider buys the ticket on the Official platform on behalf and for the account of the User and sends it to the e-mail provided. The service is useful, for example, to those who do not have a CPF or cannot pay on the Official platform.
5.2. Who provides it. The service is provided by the Management Provider, identified on the fee explanation page (www.party-os.com/en/support/fees). Neither PartyOS nor the Management Provider is the Organizer of the event or the Official platform.
5.3. Mandate. By contracting the service, the User authorizes the Management Provider to buy the chosen ticket in the User's name and to use the User's data only for that purchase.
5.4. Price. The ticket amount displayed corresponds to the public price of the batch in effect on the Official platform. The management fee is charged separately and appears separately in the summary. When the price on the Official platform cannot be confirmed, sales are paused.
5.5. The ticket. The ticket is issued by the Official platform, in its format, and is subject to its rules and those of the Organizer (identification, transfer, minimum age, entry). When the Official platform requires the holder's data, the data provided by the User is used.
5.6. Delivery time. The ticket is sent within 24 (twenty-four) hours after the payment is confirmed, and always before the event starts.
5.7. When the purchase is not possible. If the Management Provider is unable to buy the ticket (batch sold out, price changed, failure of the Official platform or any other reason), the User receives back the total amount paid, including the management fee, within 7 (seven) days, through the same payment method.
5.8. Cancellation or postponement by the Organizer. If the event is cancelled, the Management Provider requests the refund from the Official platform and returns to the User the total amount paid, including the management fee. In case of postponement, the options offered by the Organizer and section 6 apply.
6. Withdrawal, cancellation and refund
6.1. Right of withdrawal. The User may withdraw from the purchase within 7 (seven) calendar days from the purchase, under art. 49 of the Brazilian Consumer Protection Code (Código de Defesa do Consumidor), and receives back all amounts paid, including fees. The request must be made at least 48 (forty-eight) hours before the event starts, so that the ticket can be cancelled. A cancelled ticket is no longer valid.
6.2. Outside that period, exchanges and refunds follow the Organizer's policy shown on the event page.
6.3. Cancelled event. If the Organizer cancels the event, the User receives back the ticket amount. For Own events, the service fee is refunded on card purchases and retained on PIX purchases. For Managed-purchase events, the refund is of the total amount paid (section 5.8).
6.4. Postponement or relevant change. If the event changes its date, time, venue or main act, the ticket is valid for the changed event. A User who cannot or does not wish to attend may request a refund under the conditions of item 6.3 within 30 (thirty) days from the notice of the change.
6.5. How to request. Through customer support (section 10), providing the order number. The refund is made through the same payment method: PIX within 10 (ten) business days; card by reversal (estorno), which appears on the statement according to the card issuer's rules.
6.6. Who pays the refund. For Own events, the ticket amount belongs to the Organizer, who is responsible for the refund; PartyOS carries out the refund. For Managed-purchase events, the party responsible is the Management Provider.
6.7. Card disputes. Before opening a dispute with the card issuer, the User may contact customer support, which responds within 5 (five) business days. Tickets from disputed purchases may be cancelled.
7. Use of the ticket and prohibited conduct
7.1. Each ticket issued by PartyOS has a unique QR code, valid for one entry. The first scan at the door is the one that counts; copies of the same QR code are rejected. The User must keep the ticket safe and not share it.
7.2. The Organizer may require a photo ID and apply the event's entry rules (minimum age, security search, prohibited items). Anyone who breaks these rules may be denied entry without a refund, unless the law provides otherwise.
7.3. It is prohibited to:
- resell tickets issued by PartyOS for commercial purposes without the Organizer's authorization;
- use bots, scripts or automated means to buy or reserve tickets;
- use third parties' payment data without authorization, or open disputes in bad faith;
- falsely claim the right to a half-price ticket;
- attempt to access restricted areas of the platform, other users' accounts or data that is not their own.
7.4. In case of fraud or violation of these Terms, PartyOS may cancel the tickets involved, suspend the account and report to the authorities, with the User guaranteed the right to respond through customer support.
8. Responsibilities
| Who | Is responsible for |
|---|---|
| Organizer | Holding the event, line-up, venue, security, entry rules, half-price tickets, prices and batches, cancellation or change of the event |

8.1. PartyOS strives to keep the platform available, but there may be interruptions for maintenance or due to third-party failures (internet, payment or e-mail providers). In such cases, PartyOS works to restore the service and resend anything pending.
8.2. Nothing in these Terms limits the User's rights under the Consumer Protection Code.
9. Personal data, intellectual property and changes
9.1. Personal data. PartyOS processes personal data in accordance with the Brazilian General Data Protection Law (Lei Geral de Proteção de Dados, Law no. 13.709/2018) and the Privacy Policy (in Portuguese), which states what data is collected, for what purpose, with whom it is shared and how to exercise the data subject's rights.
9.2. To fulfil the purchase, PartyOS shares the necessary data with: the event Organizer (guest list and entry control); the Management Provider and the Official platform, for Managed-purchase events; the payment institution; the e-mail delivery provider and the other providers listed in the Privacy Policy (in Portuguese); and authorities, when required by law. PartyOS does not sell personal data.
9.3. Data protection officer (DPO): Alejo Rodriguez, at the e-mail partyoperationsystem@gmail.com.
9.4. Intellectual property. The PartyOS brand, website and software belong to its operator. Event names, images and brands belong to the respective Organizers.
9.5. Changes. PartyOS may change these Terms. The current version is always available at www.party-os.com/en/terms, with the date of the last update. Changes do not affect purchases already confirmed, which follow the Terms in effect on the date of purchase.
10. Customer support, complaints, governing law and jurisdiction
10.1. Customer support. E-mail partyoperationsystem@gmail.com and WhatsApp +55 21 97418-7777, every day, from 10:00 to 22:00 (Brasília time). PartyOS responds within 5 (five) business days, in accordance with art. 4, V, of Decree no. 7.962/2013.
10.2. Complaints. Without prejudice to direct customer support, the User may file a complaint at consumidor.gov.br or with the PROCON of their state (in Rio de Janeiro, PROCON-RJ).
10.3. Governing law. These Terms are governed by the laws of the Federative Republic of Brazil, in particular the Consumer Protection Code (Law no. 8.078/1990), the Brazilian Internet Civil Framework (Marco Civil da Internet, Law no. 12.965/2014) and Decree no. 7.962/2013.
